1. scope of application
Orders in the GartenLandschaft Shop are subject exclusively to these General Terms and Conditions in the version valid at the time the contract is concluded. By placing an order, the customer agrees to these General Terms and Conditions. Deviating agreements must be made in writing.
2. conclusion of contract
The presentation of the goods in the webshop does not constitute a legally binding offer, but is to be understood as an invitation to the customer to make an offer himself. The contract is concluded upon acceptance of the order, either by sending an order confirmation by e-mail, fax or letter or directly by dispatching the ordered goods. An automatically generated order confirmation by e-mail does not constitute acceptance of the offer, but merely documents that the order has been received. GartenLandschaft reserves the right not to accept orders.
The contract, order and business language is German.
3. right of withdrawal in distance selling
The withdrawal period for a consumer within the meaning of the KSchG from the conclusion of a distance selling contract is 7 working days. In the case of deliveries of goods, it begins with their receipt by the consumer. The day on which the deadline is triggered (conclusion of contract or receipt by the customer) does not count. Withdrawal can be made without giving reasons in writing by e-mail, fax or letter to the contact details below or by returning the goods within the withdrawal period to the address below.

In the event of an effective revocation/withdrawal, the services received by both parties must be returned step by step. The purchase price will only be refunded if the goods are in an unused and resalable condition. If the customer is unable to return the service received in full or in part or only in a deteriorated condition, a reasonable fee shall be charged for the reduction in value.
The shipping costs for returns due to an effective revocation shall be borne by the customer.
4 Prices and terms of payment
Unless otherwise stated, all prices are gross prices including statutory VAT and excluding all expenses incurred in connection with shipping.
Payment is made by invoice.
5. delivery and shipping costs
Delivery shall be made to the delivery address specified by the customer.
The shipping costs are based on the current postal rate. The final shipping costs will be communicated to the customer in a final cost overview before the order is sent.
Shipping is carried out by DHL. Dispatch normally takes place within 7 working days of receipt of the order.
6. warranty
The statutory warranty provisions shall apply unless expressly agreed otherwise.
7. data protection
Personal data is collected, processed and used exclusively within the framework of the statutory provisions. The data transmitted with the order will only be stored and processed for the purposes of customer records.
Customer data will not be passed on to third parties unless this is absolutely necessary for contract processing (e.g. shipping).
